Indian politics ~ A lawyer’s club ??




Yesterday I visited Gujarat high court first time , its “Parking for Advocates” Full by Audi, BMWs and other costly cars .

Then one incident come in my mind :which I read in the book “ Freedom at midnight”

When
Mountbatten came to India to discussed about the plan for Indian independence , he debated this with 4 person independently .

the list include : Gandhi , Patel , Naheru and jinah and interesting all these 4 were Barister. So, lawyers dominated politics in india before independence

but on other side It’s well known fact that : The Indian freedom struggle was won by the army of lawyers who used words for ammunition.

before independence barrister give their time and money for nation building , Patel - earned a reputation as a fierce and skilled lawyer though he leave practice and become full time Independent activist , same also in case of Gandhi, Naheru etc

“Almost 250 members of the 348-member strong Constituent Assembly, which drafted the Constitution of India, were lawyers”  ~ R Venkata Rao, vice-chancellor, National Law School of India University (NLSIU).

these  Barristers before independence Struggle for liberty, equality, justice .

Today lawyer look like the broker of justice , court a place to decide a broking rates just like Bombay stock exchanges and case like shares

Today  the way of politics and power pass through advocacy , we have a barrister loksabha speaker, barrister leader of opposition of both house, barrister defense , finance and external minister and many more advocated in ministry.

                                          
                


It’s the Indian judiciary who make difference between “Bharat” and “India”

But it’s not only to India...there is something in democratic structure that : Who know laws and regulation , power always focused on their hand .

Take a example of America...USA... Mr Obama went to Harvard Law School his cabinet contains Hillary Clinton (Yale Law) as secretary of state, Eric Holder (Columbia Law) as attorney-general, Joe Biden  as vice-president and Leon Panetta (Santa Clara University law school) as director of the CIA. That's the tip of the iceberg.
    
                                                            



Over half of America's senators practised law. Mr Obama's inner circle is sprinkled with classmates from Harvard Law: the dean of that school, Elena Kagan, is solicitor-general; Cass Sunstein, a professor there, is also in the administration. ( The economist : There was a lawyer, an engineer and a politician...)

So,there is some aspect in democratic system that Lawyers always Dominated the politics.
                                                                 
politics  is an option that is not open to others such as engineers, economists and doctors who can successfully straddle public life and private careers in India ,but lawyers and criminals can do it .

Here is some stats that prove this :-

>> MP from Rajasthan Abhishek Manu Singhvi in his professional engagement as a Senior Advocate earns a cool Rs 50,00,00,000

>> BJP MP from Gujarat Arun Jaitley, who as senior advocate earns Rs 10,00,00,000.

>> BSP MP from Uttar Pradesh Satish Chandra Mishra as a partner in law firm Misra and Misra Associates earn Rs 3,44,56,780.

since the vedic time...it’s true that who makes law it dominated over society at that time  Bramins are law makers and they dominated the whole society

In democracy ,

When a policy is in the making, Legislators (politicians) hold the power to draft laws . The Executive(Civil servants) branch enforces the law, while, the Judicial (Lawyers)branch takes care of the legalities.

So, economists, engineers and doctors have not any specific place in power process in democracy.

Civil servants and lawyers know the laws and regulation so they can simple understand the constrain in system so they can get benifits from the system

But civil servant can not be a Legislators during their service, so they become politicians after their retirement where lawyers can  be a Legislators with their legal practice.

So, Indian parliament just look like the Lawyers club !

                                                                     
                                                                            



Countries often have marked peculiarities. Egypt likes academics; South Korea, civil servants; Brazil, doctors). Some emerging-market countries are bedevilled by large numbers of criminals.
