Identity of AAM AADAMI In Constitution
AAM AADAMI mean citizen of India . Here I try Little to find contradiction of Written constitution and Real one !
Constitution mean Rule of Law ! Indian constitution borrow many features from others constitution like Bicameral parliament from UK , Supreme court from USA , Election of president from Ireland etc. but Foundation of all from in RULE OF LAW ! Rule of law is originated in religion .
Now come on Identity : Our world, and our lives, are being shaped by the conflicting trends of globalisation and identity” #EPW
On the paper We are world biggest democracy but It's just like our cricket team look Good only on paper and reality is totally different !
Our Constitution is most Undemocratic paper in world : It's The prepared by Constituent Assembly of India who were unelected members ! Indian constitution is call as Secular but there were special representation of Muslim and Sikh in that on the name of minority but No other minority have special representation like Muslims !
Constitution mean Rule of Law : And Mahabharat said that : Although king is Invest with Authority and power but true sovereignty belongs to dharama not the king ! King is also bound by the Rule of Law ! IN today;s date King mean Prime minister and Dharma mean Our Constitution ! on those day Rule of law made by Bramins and they also look watch on the king that He follow rules well or Not ! And Today the king ( Parliament ) make laws and there is no Absolute Body in World biggest democracy who look watch on tham ! there is supreme court and CAG but they also have limited power and They both became Corrupt
That's why Shunil khilananli said in book The Idea of India : Indian constitutional democracy created in the fit of absentmindedness hence Liberalism was bound to fail in this culture !
Mahabharat also said that : It's people right to throw out the king is he do not obey Rule OF law ! that's why There was Anna Aandolan last year but as Karl marx said : Revolution can only success where Lower class people attached with it ! Very less Middle class people movement got success in history , so India is now in the process of Isolation ...when it reach to saturation of Capitalist vs./ labour class than there will be a Kranti
As recent example : Land less people start march from MP - Delhi with 30000+ people and fianlly they come to reach on the agreement with Jairam ramesh for Agreement and Government of India do promise to give land to all land less people ! It's nearly impossible thing where on other hand Government Do not ready to move 1 step ahead in the case of Lokpal the simple thing is that in 1st there is lower class and on other side it's lower class struggle movement !
On lokpal the main Argument from Government is : How can we give absolute power to Lokpal ? & What will happen if lokpal will become Corrupt in Future ? There is common answer of Both Question : Supreme court ! Our constitution gave Highest power to supreme court and it became Totally corrupt today, IF you want to read example than Refer OPEN magazine Radia tapes ( In that Prabhu chawla talk about the power of Ambani's to decide judgement in supreme court )
Neither today nor at time of drafting of Constitution , Aam aadami can look his identity in that ! Are we really bound to follow Constitution ? Where is any Citizen signature on the official paper that He/she is ready to follow Indian constitution ? I think 0.1% people of Indian Aam aadami aware about the constitution !
As example : In the case of Cable Amendment Act. Government took this rule under pressure of DTH services comply and do large advertizement in both electronics and print media it's due to batter implementation of that act . ! but Have you seen any other Act. Advertizement on such manner ? Government should start Cam pain about Constitution awareness on large scale but they don't !
Government give some power to Aam AAdami through RTI in 2005 and after 7 year it's prove effective so, govermnent start try to Amend it !
There Are some Act. in constitution which is totally Oppose to Constitution preamble ! The main Controversial point is : Which one is more important in these two : Rule of Law OR Liberty ?
JUSTICE, social, economic and political ----> Today no one believe in justice , one judicial Come tee report said that Indian judiciary will take time of 324 years to solve the pending cases , Some power full people can boost or delay case according to their need that we seen in the case of SSP and Jesica lal
LIBERTY, of thought, expression, belief, faith and worship ----> For though and expression there is sedidation law, under this government detained Aam AAdami like binayak sen, asim trivedi etc. and in Worship --> Muslim get subsidy from government for visiting makka-madiana, and Hindu pay 7.5 lakh for visiting great kailash manasarovar !!!
EQUALITY of status and of opportunity ---> B.R.Ambedakar himself said : We give Political equality to Citizen by one man, one vote but there is no existence of Economical and social equality , Reservation is also a example of in--equality !
In short Aam aadmi lost his Identity in Today's Government !
