Open letter to Nandan Nilkeni : why your article on Aadhar call for an appeal ?

Sir, Last year during the Time of the election campaign of the loksbha I wrote
that : “Our politician use the name of the our national leader just like JUST
DIAL : कुछ भी , कभी भी कही भी”. Your article in Indian express prove this line
true once again as You use the Name of the Gandhiji in Improper context.
In Opening paragraph of the
article , You say that SC judgment on the Aadhar failed the test of the Mahatma
Gandhi. You talking about the test that Gandhi taught to the Some members of
the “Great” Constituent assembly. The test advise the members that : “Recall the face of the poorest and the weakest
man you may have seen, and ask yourself if the step you contemplate is going to
be of any use to him”
Now Come to the Your Context in which you use the
name of the Bapu : It seems that you might not know that Gandhiji experimented
first ever Satyagrah in transval against the “Asiatic Registration Act”.
Under the Act every male Asian had to register himself and produce on demand a
thumb-printed certificate of identity. Unregistered persons and prohibited
immigrants could be deported without a right of appeal or fined on the spot if
they fail to comply with Act. Gandhiji called it the “Black Act" on the
grounds of the safety of the Indian community, and to prevent the Asiatic
community of South Africa suffering an intolerable humiliation.
Though South Africa was the colony of the British
and Gandhi was the Indian immigrant from India , He fought the battle against
the discriminatory act and Today In Independent India , On the Name of the
Gandhiji, Mr.Nikleni you Making “humble” request to Supreme court to
Reconsider the Stand on The Aadhar which have the Similar issue that
"Asiatic Registration Act” had. ( I know that Both Issue are the
Different but basic theme is the Biometric registration). Number of the Indian
people rising the question over the chances of misuse of Aadhar data by the
Political parties.
Dear Nilkeni sir , You wrote these two lines in
article (1) Freedom of executive to frame policy (2) Aadhar system
ensure the privacy by design. This Are contradictory in nature as far as the Aadhar is concern. This show that You do not have the enough
Knowledge about the basic theme of the Indian constitution of the “Check and
balance” between the Legislative, Executives and Judiciary”
We oppose the Aadhar cause it do not have the
proper check and balance on the issue of the Bio metric data of the citizen.
Have you Answer of this question : “Who will be responsible in case of the
theft or misuse of the data” ? ( I ask the similar in RTI but no satisfactory
answer form UID) . Hope You aware about this fact that “Authority come with
responsibility and vice versa” . You want to give the freedom to take decision
to Executives then Will the same executive ready to take the responsibility of
the Misuse of the data? Have you answer of this question ?
Now come to next point on the application of the
aadhar. In case of the sharing of the Aadhar data to Banks ( In KYC) you wrote
that : “The data is only shared with the customer’s consent. Most
importantly, the same data is already widely available on the internet via
election rolls”.
I like to tell you Mr.Nilkeni that You might forget
that Indian adult literacy rate is 74% ( And that also official figure) - That
mean 26 out of every 100 can not read in India. In addition there are million
of people like me having 3 engineering degree holder whom I like to call
“Illiterate legal fool” who do not read the document before sign. Now Tell me
Is this argument of the “customer’s consent” have any effect ? . Sir , I think
I have no need to make any comment about your effort to make the comparison
between the Type and Application of the data of the electoral rolls and Aadhar.
In concluding paragraph you wrote : “Aadhaar is
critical plumbing for the Indian state to leapfrog developed countries in
creating a modern welfare state, end poverty, create opportunities and
meet our tryst with destiny”.
I like to ask you That : Aadhar help to End the
poverty just cause the you were the former chairman of the UIAI ? If you think
that Aadhar help to end the poverty then You should write in Starting paragraph
not in conclusion and should show the way with examples how it help to end the
poverty. Just “Trying” to stop the leakage of the subsidy leakage is not end of
the poverty . In fact the Economic survey of Indi 2014-15 Said that Subsidy are
“regressive” in Nature. The Economic survey said that “Subsidies aren't
best weapon to tackle poverty”.
As you started article with the name of the
Gandhiji , I like to end this letter with mention of Gandhiji . I Like to
make a request to read and implement this : Gandhiji's Concept of Trusteeship
( Aadhar card is
voluntary , This is the stand taken by the SC after the mandatory penetration
of the aadhar in various schemes and Today also through Indirect channel it’s
mandatory in virtual way)
